O Sistema Africano de Proteção dos Direitos Humanos e dos Povos: uma contextualização necessária

A história e estruturação do Sistema Africano de Direitos Humanos e dos Povos (SADHP) são profundamente influenciadas pelo contexto histórico do continente, moldando seus documentos fundantes e direitos tutelados. Apesar das críticas frequentes à sua credibilidade, eficácia e relevância, especialmente no início de sua implementação, a Corte Africana de Direitos Humanos e dos Povos (Corte ADHP) e a Comissão Africana de Direitos Humanos e dos Povos (Comissão ADHP) têm desempenhado um papel vital ao dar voz às vítimas de violações e instigar Estados africanos a cumprir suas obrigações sobre o Direito Internacional dos Direitos Humanos (DIDH) . A fundação do SADHP inaugurou uma nova era de proteção aos direitos humanos na África, visando combater atrocidades e formas de discriminação. Embora enfrente desafios, o sistema demonstra potencial de desenvolvimento avançado.
Este estudo, ao explorar a origem histórica, a Carta de Banjul e os desafios atuais do SADHP, busca ir além dos estereótipos, sensibilizando para as discussões que impulsionaram sua criação e indicam seu progresso na garantia dos direitos humanos.
