GLOBAL OVERVIEW ON THE RESPONSIBILITY OF TRANSNATIONAL COMPANIES FOR HUMAN RIGHTS VIOLATIONS

The purpose of this paper is to investigate the main regulatory instruments on Human Rights and Business, and to relate the actions of transnational companies based on the phenomenon of globalization. The relevance of the subject lies on the constant violations of Human Rights that occur around the world caused by transnational corporations. In addition, it seeks to investigate the existing international instruments that regulate the performance of transnational companies, whether hard law or soft law, such as the UN Guiding Principles, OECD Guidelines and the Tripartite Declaration on Multinational Companies.The work also investigates the existing regulations on the subject at the international level and the Brazilian territory, with emphasis on the forecasts of mandatory due diligence in Brazilian norms and guidelines on the subject. Finally, it investigates the development of a binding instrument on the subject (International Treaty on Human Rights and Business), its impacts, the context and the status of the draft.
