This paper critically examines the contemporary forces shaping constitutional legal theory and their influence on international law—whether as foundational concepts or as outcomes of sociological, philosophical, and normative developments forged by the collective action of the international community. Drawing on modern theories of constitutionalism and neo-constitutionalism as a theoretical framework, and addressing the viability and legitimacy of global governance, the study closes with a provocation inspired by its subtitles. This inquiry seeks to formulate new questions and perspectives in response to the evolving legal and political realities of globalization.
