DEVIDA DILIGÊNCIA EM DIREITOS TRABALHISTAS: UMA ANÁLISE CRÍTICA DA LEGISLAÇÃO ALEMÃ DE DILIGÊNCIA EM CADEIAS GLOBAIS DE FORNECIMENTO

O dever da devida diligência, conforme o Princípio 17 dos Princípios Orientadores sobre empresas e direitos humanos da OCDE, inspirou novas regulações nacionais em cadeias de fornecimento em países do Norte global. Em 2021, a Alemanha promulgou a Lei de Diligência em Cadeias de Fornecimento, visando proteger os direitos trabalhistas em suas extensas cadeias de fornecimento transnacionais. Este estudo examina o escopo, abrangência, obrigações e sanções da lei, além de apresentar perspectivas críticas sobre seus possíveis impactos nas empresas alemãs e suas cadeias de valor. Conclui-se que, apesar de suas intenções, a lei possui lacunas e, isoladamente, não garante a prevenção de violações de direitos trabalhistas.
